JAY LINGERMAN and JANET LINGERMAN v. RAYMONT GOSSELIN, 6 MILL ROAD, LLC, and BRIAN HONE, JOHN STANBURY JR., CATHRYN CHADWICK, KATHLEEN MILANO, HEIDI PAEK, and SUZANNE BENFIELD as members of the Town of Ipswich Planning Board.

For the reasons set forth in the court’s Memorandum and Order of this date, the Gosselins’ motion to dismiss is DENIED. The Lingermans’ motion for summary judgment is DENIED. Summary judgment is instead ALLOWED in favor of the Gosselins. See Mass. R. Civ. P. 56(c). The decision of the Town of Ipswich Planning Board is thus AFFIRMED in its entirety.
