This action commenced on December 13, 2019, as a complaint seeking declaratory and injunctive relief extinguishing deeded easement rights in a passageway abutting the properties of the plaintiffs and the defendants on Beacon Street in Newton Center. In a decision of even date, the court (Speicher, J.) has allowed the motion to dismiss of the defendant Murray's, LLC and has determined that the action shall be dismissed pursuant to Mass. R. Civ. P. 12(b)(9). Therefore, it is
ORDERED and ADJUDGED that the Complaint is hereby DISMISSED in its entirety, and it is further
